I would suggest that the common factor here is intelligence.
People who smoke are idiots.

I should wait for some good hard research before I open my mouth on this. It is an interesting question though. Maybe smoker's, like criminals, have a tendency to be anti-establishment, they like to rebel against what it means to be good and healthy.

the only numbers I could find about smokers in prisons had to do with marijauna.... but that could be your answer right there.... 49% of the prison population are jailed for drug offenses.

Not too many years ago, our city counsel ruled that local cops can no longer smoke in their squad cars. This affected a very high percentage of our police force. Cops and criminals — is there any connection there?
As far as smokers lacking intelligence, I don't think there's any hard evidence there. It has more to do with the popular mindset or "zeitgeist" — if you will ... When I was at the university (way back in the day), most of my professors smoked. And a lot of these fellows were gifted with superior intellects.
I suspect that criminals are less compliant than the general population. And their smoking adds to the tax base (unless they're stealing their smokes).

Let me tell you where that criminal factor is, it's all those lawyers who made out like bandits with that huge law suite brought against the tobacco companies then those politicians who when the got those settlements spent it for everything other than what it was intended for. For those who gloat over the fact, you will love it when they get to the guns, booze and god knows what else.
