employer asked employee to quit smoking is it discrimination?My employer asked me if i've ever "considered going on the nicotine patch during work hours?" so that I don't take smoke breaks during the day. Is this considered discrimination? Yes I know the risks of smoking so please don't respond unless you know the legalities of this question. Thank you.
But isn't religion also a choice? you are not born catholic, jewish, athiest... at some point in time you "choose" to honor these religious beliefs.

No, infact some companies are looking in to not hiring smokers or firing some staff that refuse to quit smoking. This has a lot to do with the rising cost of health insurance as well as smokers being unproductive during breaks.

Not discrimination at all. Many companies are actually refusing to even hire smokers. We are instituting a similar policy where I work.
